WILLS, TRUSTS, & ESTATE PLANNING
Estate planning is not cut and dry. To be sure, it normally involves drawing a Will. But more fundamentally, it is about establishing priorities, and fulfilling them through carefully considered strategies and drafting . The appropriate use of trusts, beginning with a Living Trust, is normally a key to careful planning for yourself and your family, both before and after you die.Learn more
BUSINESS & RETIREMENT
How you structure your business (e.g. sole proprietorship, LLC, corporation or partnership), and how you plan for the succession of your business, will have substantial income tax consequences, and affect family and employee harmony. Also, through careful planning with respect to your IRA or retirement accounts, you can enable your heirs to continue realizing tax free growth, while protecting those assets from dissipation.Learn more
When you die, your assets, other than those in your Living Trust, or that otherwise pass outside of your estate, will go through probate, a Court process. Your Personal Representative must collect these assets, file an inventory with the Court, assure the satisfaction of your liabilities, prepare any required estate tax returns, and file an accounting with the Court. I would consider it my privilege to represent your Personal Representative in navigating this process.Learn more
If charitable giving is an important focus of yours, charitable planning provides a unique opportunity for fulfilling your objectives in a way that also provides you with significant income and estate tax benefits. Charitable Remainder Trusts, Charitable Lead Trusts, Private Foundations or establishing a donor-advised fund with a local or regional Community Foundation are some of the strategies that my clients employ with my advice and assistance.Learn more
REPRESENTATION OF SENIORS
Seniors deserve particular attention to concerns they did not face, or plan for, earlier in their lives. How can assets be protected from depletion by future nursing home care, or other costly medical expenses? Are you or your parents at risk of being taken advantage of, financially, by another person, even perhaps members of your family? Are you vulnerable to undue influence, or abuse by a health care facility? I consider it my responsibility to be an advocate for your health and well-being. Learn more
Asset Protection is an important part of effective estate planning. Provisions in your Will or Living Trust that pass on assets to you children in further trust can protect these assets from claims by unwelcome creditors. Additionally, effective structuring of your business can insulate business assets from creditors whose claims arise outside of your business. The use of out-of-state trusts, or where the stakes are particularly high, off-shore trusts, enables you to benefit from the most advantageous protections. Learn more
